Terms & Conditions

Welcome to the official website and mobile application of Social and Development Alliance (SDA), an initiative of Darul Khair (“Darul Khair”, “SDA”, “we”, “our”, or “us”).

These Terms & Conditions (“Terms”) govern your access to and use of SDA’s website, mobile application, membership programme, donations, Qarz-e-Hasana services, and all related welfare programmes.

By accessing or using any SDA service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must discontinue the use of SDA’s website, mobile application, and services.


1. About SDA

Social and Development Alliance (SDA) is a Shariah-compliant charitable initiative established and operated by Darul Khair .

SDA works to promote financial inclusion, social welfare, and community development by providing Qarz-e-Hasana (interest-free benevolent financial assistance) and other charitable programmes for individuals and families facing genuine financial hardship.

SDA operates in accordance with:

  • The Trust Deed of Darul Khair ;
  • Applicable laws governing charitable trusts and non-profit organisations in India;
  • Other applicable laws, rules and regulations of India; and
  • The principles of the Holy Qur’an and Sunnah.

2. Definitions

For the purposes of these Terms:

“User” means any individual accessing or using the SDA website, mobile application, or related services.

“Member” means an individual voluntarily contributing to SDA through its membership programme.

“Qarz Applicant” means a person applying for Qarz-e-Hasana through SDA.

“Qarz” means Qarz-e-Hasana (interest-free benevolent financial assistance) provided by SDA in accordance with these Terms.

“Non-Member” means a person who is not registered as an SDA Member.

“Guarantor” means an individual who verifies the identity and credibility of a Qarz Applicant and assists SDA in maintaining communication where reasonably required.

“Committee” means the authorised committee appointed by Darul Khair to review applications and administer SDA programmes.


3. Membership

Membership is open to Indian citizens who are at least 18 years of age.

By becoming a Member, you acknowledge and agree that:

  • Membership contributions are voluntary charitable contributions.
  • Contributions are generally non-refundable, except where required by applicable law or in cases of duplicate, erroneous, or failed transactions verified by SDA.
  • Membership does not create any ownership, partnership, investment, shareholder, or beneficiary rights in Darul Khair Trust.
  • Members are not entitled to receive profits, dividends, interest, or any financial return.
  • Membership does not confer voting rights within the Trust.

Members whose cumulative contributions reach ₹5,000 may become eligible to receive the Warrior Against Riba Certificate, subject to SDA’s applicable policy.

Providing false information or engaging in fraudulent conduct may result in suspension or cancellation of membership.


4. Qarz-e-Hasana & Financial Assistance

SDA provides Qarz-e-Hasana, a Shariah-compliant interest-free financial assistance programme.

Members

Eligible Members may apply for Qarz based on:

  • Membership contribution level;
  • Membership duration;
  • Repayment history;
  • Verification results;
  • Genuine financial need; and
  • Availability of funds.

Non-Members

Eligible Non-Members may apply for Qarz up to ₹3,000, subject to:

  • Three (3) acceptable guarantors;
  • Masjid verification (Tasdeeq); and
  • Successful completion of SDA’s verification process.

Business & Self-Employment Support

SDA may provide Qarz for:

  • Small businesses;
  • Self-employment;
  • Livelihood development; and
  • Income-generating activities,

provided the purpose is genuine and beneficial.

Qarz shall not be approved for:

  • Luxury or non-essential purchases;
  • Gambling or betting;
  • Alcohol, drugs, or prohibited substances;
  • Illegal activities;
  • Interest-based financial activities;
  • Haram businesses; or
  • Speculative investments.

Availability of Funds

Approval of every Qarz Application is subject to fund availability.

Where SDA is unable to provide Qarz because of limited funds, the applicant may submit a written declaration explaining circumstances such as:

  • Loss of employment;
  • Serious illness;
  • Family hardship;
  • Business loss; or
  • Other unforeseen financial difficulties.

During Ramadaan, SDA may reassess such applications.

Where an applicant qualifies under the Shariah category of Gharimeen (debtors) and satisfies all eligibility requirements, SDA may, after verification and at its sole discretion, consider providing assistance through the SDA Zakaat Fund.

SDA may approve, defer, or reject any Qarz Application at its sole discretion based upon eligibility, verification, fund availability, applicable policies, and the objectives of Darul Khair.

Submitting false information, forged documents, or attempting to manipulate the application process may result in rejection, permanent disqualification, and civil and/or criminal proceedings in accordance with applicable law.


5. Self Help Groups (SHGs)

SDA may establish and support Self Help Groups (SHGs) in accordance with the Trust Deed of Darul Khair.

SHGs aim to:

  • Promote financial discipline;
  • Encourage savings and responsible financial behaviour;
  • Support micro-enterprises;
  • Improve financial inclusion; and
  • Strengthen community development.

Participation in SHGs may positively influence an applicant’s trust rating and future eligibility.


6. Borrower’s Responsibilities

Every Qarz Applicant agrees that:

  • All information and documents submitted are true, accurate, and complete.
  • Qarz shall be used only for the approved purpose.
  • Qarz shall not be used for unlawful or Shariah-prohibited activities.
  • The applicant shall cooperate fully during verification.
  • Additional documents shall be provided whenever reasonably requested.
  • Qarz is accepted as an Amanah (Trust), and sincere efforts shall be made to repay it according to the agreed repayment schedule.

7. Qarz Repayment Policy

Every approved Qarz shall include an agreed repayment schedule.

Borrowers agree that:

  • Repayments shall be made according to the agreed schedule.
  • SDA shall never charge interest (Riba), penalties, late payment fees, or hidden charges.
  • Borrowers may make partial or full repayments at any time.
  • Early repayment shall not attract additional charges.

8. Hardship & Rescheduling Policy

If a borrower experiences genuine financial hardship due to circumstances including:

  • Loss of employment;
  • Serious illness;
  • Accident;
  • Natural disaster;
  • Family emergency; or
  • Other unforeseen hardship,

the borrower should notify SDA as soon as reasonably possible.

Upon verification, SDA may:

  • Extend the repayment period;
  • Reschedule instalments;
  • Temporarily defer repayments; or
  • Provide any other reasonable relief considered appropriate.

Each request shall be assessed individually.


9. Default Policy

SDA distinguishes between genuine financial hardship and wilful default.

Genuine Hardship

Where a borrower demonstrates genuine financial difficulty and maintains communication with SDA, repayment arrangements may be reviewed.

Wilful Default

Where a borrower intentionally avoids repayment despite having the financial ability to repay, SDA may, after due verification and, where reasonably practicable, providing an opportunity to explain:

  • Issue repayment reminders;
  • Contact guarantors;
  • Suspend eligibility for future assistance;
  • Suspend membership benefits where applicable;
  • Restrict participation in future SDA programmes; and
  • Initiate appropriate civil and/or criminal proceedings in accordance with applicable law.

10. Guarantor Policy

Each Guarantor confirms that:

  • They personally know the applicant;
  • The information provided is true to the best of their knowledge;
  • SDA may contact them regarding the applicant’s Qarz; and
  • They will reasonably assist in maintaining communication with the borrower.

A Guarantor does not replace the borrower’s primary obligation to repay the Qarz.


11. Death or Permanent Disability

If a borrower dies or becomes permanently disabled, SDA shall review the case individually.

The review may consider:

  • Family financial circumstances;
  • Information from Guarantors;
  • Supporting documents; and
  • Other relevant factors.

Following review, SDA may defer, restructure, partially waive, or fully waive the outstanding Qarz where justified.

The Committee’s decision shall be final for internal administrative purposes, without prejudice to any legal rights available under applicable law.


12. Misuse of Qarz

Qarz must not be used for:

  • Gambling;
  • Alcohol or prohibited substances;
  • Illegal activities;
  • Haram businesses;
  • Luxury purchases;
  • Speculative investments; or
  • Lending money on interest.

Misuse may result in suspension of assistance, rejection of future applications, termination of membership where applicable, and legal action.


13. Appeal & Review Process

Applicants may submit a written appeal within 30 days of receiving a rejection decision.

The Committee may:

  • Review the application;
  • Request additional documents; or
  • Confirm, modify, or reverse the original decision.

The Committee’s decision shall be final for internal administrative purposes, without prejudice to rights available under applicable law.


14. Code of Conduct

All Users, Members, Applicants, Volunteers, and Representatives shall:

  • Act honestly and respectfully;
  • Refrain from abusive, threatening, or discriminatory behaviour;
  • Avoid submitting false complaints or misleading information;
  • Not offer or solicit bribes or improper influence.

Violation of this Code may result in suspension or termination of SDA services.


15. Fraud Prevention & Identity Verification

To maintain transparency and prevent misuse, SDA may conduct:

  • Identity verification;
  • Address verification;
  • Income verification;
  • Guarantor verification;
  • Masjid verification;
  • Field verification; and
  • Any other verification reasonably required.

Identity theft, forged documents, impersonation, or fraudulent conduct may result in immediate rejection, permanent disqualification, reporting to the competent authorities, and civil and/or criminal proceedings.


16. Conflict of Interest

Any Committee member who has a personal, family, financial, or other conflict of interest relating to an application shall not participate in its review or decision.


17. Use of Website

Users agree to:

  • Use SDA services lawfully and responsibly;
  • Not interfere with website or application security;
  • Not upload malware or malicious software;
  • Not attempt unauthorised access to SDA systems.

SDA may modify, suspend, or remove website content at any time.


18. Privacy

SDA respects your privacy.

Personal information shall be collected, processed, stored, and used only for lawful purposes related to SDA’s activities.

SDA processes personal data in accordance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023, where applicable.

19. Data Retention

Personal information shall be retained only for as long as necessary to:

  • Comply with legal obligations;
  • Conduct audits;
  • Administer SDA programmes; and
  • Support operational requirements.

Information no longer required may be securely deleted or anonymised.


20. Donations & Transactions

All contributions are voluntary charitable donations.

Donations are generally non-refundable except where required by law or in verified duplicate, erroneous, or failed payment transactions.

Electronic acknowledgements and receipts may be issued through email, SMS, WhatsApp, or the SDA mobile application.

Payment-related issues should be reported within 72 hours.


21. Intellectual Property

All logos, trademarks, text, graphics, photographs, software, documents, and other content are the intellectual property of Darul Khair or their respective owners unless otherwise stated.

No material may be copied, reproduced, distributed, or used without prior written permission.


22. Limitation of Liability

To the maximum extent permitted by applicable law, SDA shall not be liable for indirect, incidental, consequential, or special damages arising from the use of its website, mobile application, membership programme, donations, or Qarz services.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.


23. Termination

SDA may suspend or terminate access where a User:

  • Violates these Terms;
  • Commits fraud;
  • Provides false information;
  • Misuses SDA services; or
  • Engages in unlawful conduct.

24. Electronic Communications

By using SDA services, you consent to receive communications electronically, including through email, SMS, WhatsApp, telephone calls, and in-app notifications where applicable.


25. Notices

Official notices may be communicated through:

  • Email;
  • SMS;
  • WhatsApp;
  • Postal correspondence;
  • The SDA website; or
  • The SDA mobile application.

Users are responsible for ensuring that their contact details remain accurate and up to date.


26. Force Majeure

SDA shall not be responsible for any delay or failure in performing its obligations where such delay or failure results from events beyond its reasonable control, including natural disasters, pandemics, war, civil unrest, government actions, power failures, cyber incidents, or other force majeure events.


27. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall continue in full force and effect.


28. Waiver

Failure by SDA to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights available to SDA.


29. Shariah Compliance

SDA is committed to conducting all of its activities in accordance with the principles of the Holy Qur’an and Sunnah.

Accordingly:

  • All financial assistance is provided as Qarz-e-Hasana.
  • SDA strictly prohibits Riba (interest).
  • SDA seeks to uphold the principles of Amanah (Trust), justice, transparency, and compassion.

30. Dispute Resolution

Any dispute relating to these Terms or SDA services should first be referred to SDA for amicable resolution.

If unresolved, the matter shall be reviewed by the authorised Committee.

Nothing in this clause limits any legal rights available under applicable law.


31. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, disputes shall be submitted to the courts having competent jurisdiction in Darbhanga, Bihar, where Darul Khair is situated and where a material part of the cause of action arises.


32. Borrower’s Declaration

By applying for and accepting Qarz-e-Hasana from SDA, every borrower declares:

“I acknowledge that the Qarz-e-Hasana provided by Social and Development Alliance (SDA) is an Amanah (Trust). I undertake to use the Qarz solely for the approved lawful purpose and will make every sincere effort to repay it according to the agreed repayment schedule. If I experience genuine financial hardship, I will promptly inform SDA and cooperate fully throughout the review process. I further declare that all information and documents submitted by me are true, accurate, complete, and provided in good faith.”

This declaration forms an integral part of every SDA Qarz Application and Qarz Agreement.
